The Privy Council rules unanimously in favour of GraceKennedy Remittance Services Ltd.

On Monday, December 11, 2017 the Privy Council handed down its judgment on the matter of Paymaster Jamaica Limited’s claim against GraceKennedy Remittance Services Limited which was made by Paymaster in 2000.

The Privy Council ruled unanimously in favour of GKRS, allowing our appeal and dismissing Paymaster’s counter appeal. On the claim of breach of confidence the Privy Council found that there was no information in the software or manual in question that could have been considered confidential. With respect to the copyright claim the Privy Council ruled that Paymaster did not own the copyright in the software.

GraceKennedy Limited is happy that the Privy Council has decided in our favour on this matter, affirming that GraceKennedy Remittance Services acted honestly and with integrity with respect to its dealings with Paymaster and the engagement of the developer of the software, Mr. Paul Lowe.

The full copy of the judgment can be found at the Privy Council’s Website:
